Work Related Upper Limb Disorder Investigation

Brief: Canary Designs Principal Consultant John Lovegrove provided support to the court by identifying the steps required to understand the nature of the work associated with being a sewing machinist at the Defendants premises, the associated risks to the Claimant’s health and whether or not the Defendants controls to reduce the risk of developing ULD’s were effective.
Method
The first step for the principal consultant was to review the court enclosures to familiarise themselves with the details of the case. They then arranged to meet the claimant to gather anthropometry data, arranged a site visit to investigate the defendant’s organisational design, workspace layout and understand how work-related upper limb disorders are managed. The site visit was then written up in a report and submitted to the court for review. Following on from the submission, contact was made with the defendant’s expert and a joint witness statement was produced.
Outcome
Following the review of the evidence an increased settlement was agreed for the claimant.
